This Privacy Policy, along with our Website Terms of Use governs your use of our website at https://iskrajewelry.com/ (“Site”), its products and services that may be offered via the Site, its related social media sites, or otherwise through your interactions with us. For the purposes of this Privacy Policy, we will refer to all of these access points as Services (the “Services”). 

Personal Information means any identifying information, usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

Information Collected Directly from You

We may collect Personal Information about you when you subscribe to our newsletter, visit or our Services, complete a transaction through the Services, contact us, create an account, or as part of other online services.

Collecting Information from Children Under the Age of 18

Our Services are not designed or targeted for children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on our Services without their permission. If you learn that a child under the age of 18 has provided us with Personal Information in violation of this Privacy Policy, then you may alert us at hello@iskrajewelry.com. We will take reasonable steps to delete that information as quickly as possible.

How Is the Information We Collect Used?

We use Personal Information for a variety of purposes related to our business, including but not limited to:

Providing products on the Services, performing the essential functions of the Services including responding to inquiries, fulfilling requests, providing support and troubleshooting, data aggregation, analysis and report creation to assess marketing effectiveness and/or business performance, and communicating with users about their use of the Services or responding to a user initiated inquiry on the Services. 

To process transactions, including billing, account management and other administrative matters.
We will use your information to process transactions. This includes processing discount codes (if applicable) and payment. We may need to contact you for invoicing, account management and similar reasons, and we use account data to administer accounts and keep track of billing and payments.

Communicating with users about our services
Sending or initiating direct marketing programs, such as newsletters or information about new programs we are offering; using content from social media platforms where users discuss our programs or use a hashtag related to our programs. Sending communications to you if you contact us and request information or have questions or comments.

Personalizing user experiences on our Services
Tailoring content on the Services based on user location, preferences, and other personalization factors.

Analytics and Services improvement
Tracking information about your visits to or use of our Services to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the Services and develop additional services to offer.

Partners and Affiliates 

We may disclose Personal Information with our business affiliates or related entities, as necessary or appropriate to enhance your experience and provide you with tailored services or to manage our relationship with you.  

Service Providers

We may disclose non-individual information, in the aggregate, regarding your online browsing preferences to allow certain of our service providers with whom we work with to better serve our users. We will not disclose personally identifiable information in these instances, other than as described in this Privacy Policy. These service providers help us initiate direct marketing programs on our behalf, do data tracking, maintain or develop our Services, and provide products and offerings related to our products.

We may also disclose certain Personal Information with our manufacturers, agents,  shipping companies, credit card processing company, payment service provider(s), email service provider(s) and other third parties necessary to fulfil an order for products placed through the Services. These third parties are contractually or otherwise legally prohibited from using your Personal Information for promotional purposes or from selling your Personal Information. These third-party service providers may have access to information about you if it is needed to perform their functions for us, but they are not authorized by us to use or disclose such information except as necessary to perform services on our behalf or to comply with legal requirements, and they are required to maintain the information in confidence. 

 

Shopify 

We use Shopify to host our website, power our online store and to process, orders, payments, and related services. In this context, Shopify acts as our service provider and we may disclose your information with Shopify to deliver our Services to you on our behalf.  However, Shopify may also process limited Personal Information to provide, develop, and improve its analytics, advertising and other products. By using our Services, you consent to allow Shopify to collect Personal Information about you, place cookies necessary for our Services to function and complete checkout during transactions. Compliance and Legal Obligation

We may also disclose your Personal Information in connection with government or law enforcement requests or in response to investigations, subpoenas, court orders, or other legal processes to: operate this Services, process any orders or registrations, protect the rights or property of ISKRA, its affiliates, users, and applicants establish or exercise our legal rights or defend against legal claims, or as otherwise

 

Business Transfers

We may also disclose your information to a third party as part of reorganization or a sale of the assets of ISKRA. Any third party to which ISKRA transfers or sells the Services or related assets will have the right to continue to use the personal and other information that you provide to us. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.

 

Other Third Parties

We do not disclose your information with unaffiliated third parties for their independent marketing purposes to directly market their products to you. 

Cookies and Similar Technologies

We use cookies and similar technologies to gather information about your use of our Services and to customize your experience using the Services. 

 

Pixels

Pixels are small transparent images embedded in a site, email or ad and may provide information to platforms such as Google, Meta or TikTok, who may combine your information with other information they have about you. We pixels like Meta Pixels to automatically collect information when You visit our Services. These technologies usually track advertising preferences from site to site, and gather data about a users’ browsing habits to improve the user experience. Certain Pixels like Meta Pixels can be used in conjunction with Conversions API (CAPI), to help us better understand the performance of our ads. You may seek to block tracking pixels by installing a dedicated browser extension or ad-blocking extension for that purpose or by adjusting your browser privacy settings.

Cookies are small data files that help us keep track of your usage of the Services. Many of the cookies we use enable the Services to function as you would expect it to. Persistent cookies enable the Services to remember things like your login information for convenience, and session cookies are useful for things like keeping the items in your shopping cart when you navigate away from the page, all of which allows us to enhance the user experience. Necessary Cookies are necessary for the Services to function such as Shopify cookies to process your order checkout. If you refuse them, you will not be able to use the Services, as the Services will not function properly without them.  

Functional Cookies help us enhance the performance and functionality of our Services to remember your choices, setting, or preferences from one visit to the next. These are not necessary for your use. Still, certain functions or features may become unavailable if you refuse them.

Analytics/Performance Cookies collect information about your use of our Services, including which pages you visit, and whether you experience any errors. These cookies do not collect any personally identifiable information. The information collected is only used to analyze how the Services is being accessed and used in order for us to improve the Services and your experience using it.

Google Analytics

You can opt-out from being tracked by Google Analytics in a particular browser on a particular device by downloading and installing the Google Analytics Opt-out Browser Add-on for that browser.

 

Marketing Communications

You have the right to opt-out of marketing communications and newsletters we send you.

If you no longer want to receive marketing-related emails or newsletters from us, you can opt-out of receiving such emails by clicking the “unsubscribe” link at the bottom of any marketing email you receive from us. Please be aware that you will continue to receive certain communications from us that are necessary for our services. If you are having difficulty unsubscribing from our marketing emails using the above method, please contact us directly by email.

By providing your phone number, you consent and agree to opt-in to receive automated text messages. Message frequency depends on the marketing offers we provide.  You may opt out of receiving text messages by texting “Stop” at the end of any message you receive, or you can opt out of these communications by contacting us at hello@iskrajewelry.com and sharing the phone number that you would like to opt out. You may also reply “Help” for help. Messaging and data rates may apply. 

We may disclose your SMS opt-in or consent status, with third parties or marketing affiliates that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. We will not share or sell your phone number, your opt-in to the SMS with third parties for their direct marketing purposes or for purposes unrelated to our Services. You may opt out of receiving SMS text marketing messages by texting “STOP” at the end of any message you receive, or you can contact us at hello@iskrajewelry.com.

 

Social Media Links

Our Services may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The Services may also contain certain social media icons or widgets, such as Instagram, TikTok, Facebook, LinkedIn, and Youtube. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.

 

Payment Information

We use third-party payment processors, such as Shopify or Stripe, to process payments. Your credit card details are communicated directly from your browser to these payment processors. ISKRA only sees the payment card type, the last four digits of your credit or debit card number and billing address. Please see Stripe’s and/or Shopify’s terms of service and privacy policy for more information on how they use, and store your Personal Information.

 

How is User Information Protected?

We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our Services, designed to protect your Personal Information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, we cannot make any guarantees as to the security or privacy of your Personal Information.

 

Data Retention Policy

We retain your Personal Information for as long as necessary to satisfy the purpose for which it was collected. We may retain your Personal Information for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, collect debts, etc. or as permitted or required by applicable law. We may also retain your Personal Information in a deidentified or aggregated form so that it can no longer be associated with you.

To determine the appropriate retention period for your Personal Information, we consider various factors such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we process your Personal Information; and applicable legal requirements.

 

Your Privacy Rights

Texas Residents

If you are a Texas resident, you may have  certain privacy rights with respect to your Personal Information: 

• Right to request deletion of your Personal Information 

• Right to challenge the accuracy and completeness of your Personal Information and to have it corrected, as appropriate

• Right to data portability and request access to your Personal Information and receive an accounting of how that information has been used and disclosed, subject to certain exceptions prescribed by law

• Right to opt out of targeted advertising, the sale of your Personal Information, and profiling in furtherance of decisions that produce legal or similarly significant effects

• Right to appeal if we deny your privacy request 

If your request for these rights is denied, we will notify you in writing of the reason for such denial. To request these rights, please contact us at hello@iskrajewelry.com and/or via contact form. When we receive your request, we will first verify your identity by asking you to provide your name, and the email address and phone number reflected in our records. Once we have verified your identity, we will promptly fulfill your request. You may also authorize an agent to submit a request on your behalf.

Other States 

Other U.S. states may provide you their residents with certain privacy rights. As a resident of such states, you may have the right to submit certain requests relating to your Personal Information as described below based on applicable laws. • Right to access and data portability. You can request and receive a copy of the Personal Information we have collected, used, or otherwise processed and you can confirm what Personal Information has been collected. 

• Right to correct inaccuracies. You can request that we correct any inaccurate Personal Information we may have.  

• Right to delete. You can request deletion of your Personal Information. 

• Right to opt-out.  You can opt-out of targeted advertising, the sale of your Personal Information or limited sharing of your Personal Information. 

• Right to appeal. At times we may be unable to process requests relating to your Personal Information, in which case, your request will be denied. If your privacy rights request has previously been denied by us and you believe we denied it in error, you may appeal for reconsideration of your request via emailing hello@iskrajewelry.com

Please note that we may need to authenticate your identity before your request can be processed, providing us with 2-3 pieces of Personal Information which we will match to information we maintain about you. For authentication, you may be asked to provide certain Personal Information that we will match against our records. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

 

Non-Discrimination

We will not discriminate against you in a manner prohibited by the applicable state laws because you exercise your privacy rights. While you may request to delete your Personal Information, such deletions may affect our ability to offer the Services to you.

 

International Transfers 

We are located in the United States and direct our Services to users in the United States. The Personal Information that we collect is stored on servers hosted by us or our authorized third-party service providers located in the United States. For users outside of the United State, this means that your Personal Information will be collected, processed, and stored in the United States, which may have data protection laws that are different from (and sometimes less protective than) the laws of your country or region, such as the GDPR (“General Data Protection Regulation”). 

By using our Services, you agree and consent to such transfer of Personal Information to the United States.  We have implemented safeguards we believe are designed to ensure that the Personal Information we process remains protected in accordance with this Privacy Policy, including where processed internationally or by our third party service providers and partners.  

 

Do Not Track Signals

Certain internet web browsers allow a “do not track” (DNT) setting that relies on a technology known as a DNT header, which sends a signal to websites visited by the individual about the individual’s browser DNT setting. At this time, we do not currently respond to DNT signals, whether that signal is received on a computer or on a mobile device. 

 

Changes to this Privacy Policy

ISKRA may update this Privacy Policy from time to time, in its sole discretion. If we do so, we will post an updated Privacy Policy on the Services.  Changes, modifications, additions, or deletions will be effective immediately upon their posting to the Services. We encourage you to review this Privacy Policy regularly for any changes. Your continued use of the Services, and/or your continued provision of personal information to us after the posting of such notice, will be deemed an acceptance of any changes and subject to the terms of the then-current Privacy Policy.
